It has come to our attention that there are salespersons going door to door selling solar panels. They are stating that there is a new Indiana law overruling our covenant. As it stands, solar panels are not permitted in Sungate. The salespersons are incorrect about this law. Please note the actual law and go to Section 4.0.
Indiana Solar Panel Law – HEA 1196
Here is what our property manager told the board:
“The law did not overrule the covenants. It made it to where the homeowner has to go through a certain procedure and meet the state requirement, per the law, before the Association would have to allow them to have them. It applies to those who have been denied solar panel installs. The interesting fact is that each homeowner that is denied has to go through this process. One homeowner going through it DOES NOT give blanket approval to everyone else. Each person has to apply, be denied and then jump through the hoops.”
The law states that each individual has to go through the approval process, get 65% of all homeowners approval and then the board can approve. Be advised that installing solar panels is against the covenant in Chapter 29.
